Terms of Use

Welcome to Wappigo ("Wappigo", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the Wappigo website, web application, mobile applications, APIs, Meta and WhatsApp integrations, and related omnichannel messaging services (collectively, the "Services").By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

1. Acceptance of Terms

By creating an account or using Wappigo, you acknowledge that you have read, understood, and agree to these Terms. If you are using Wappigo on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must: be at least 18 years old; have the legal capacity to enter into a binding agreement; comply with all applicable laws and regulations.

3. User Accounts

You are responsible for: maintaining the confidentiality of your account credentials; all activities that occur under your account; ensuring that your account information remains accurate. You agree to notify us immediately of any unauthorized access to your account.

4. Description of Services

Wappigo provides cloud-based software for managing customer communications and business workflows, including WhatsApp Business Platform messaging, team inboxes, customer and contact management, contact list imports, bulk and template messaging, scheduled messaging, automation, analytics, API integrations, multi-user collaboration, channel connection management, webhooks, AI-assisted features, and other communication and productivity tools. Some features may require additional subscriptions, business verification, approved templates, or third-party accounts.

5. Acceptable Use

You agree not to: violate any applicable law; send spam, unsolicited, deceptive, or prohibited communications; contact people without a lawful basis or required opt-in; ignore unsubscribe, block, stop, or opt-out requests; distribute malware or harmful software; interfere with the operation of the Services; attempt unauthorized access; use the Services for fraudulent, illegal, discriminatory, abusive, gambling, political persuasion, or high-risk regulated activities where prohibited; infringe intellectual property rights; or upload malicious or unlawful content. Violation of these Terms may result in message blocking, suspension, termination, or reporting to the relevant platform provider or authority.

6. Third-Party Services

Wappigo integrates with third-party platforms including Meta's WhatsApp Business Platform, WhatsApp Cloud API, Meta Graph API, hosting providers, analytics providers, email providers, payment providers, and other external services. We are not responsible for third-party API changes, outages, rate limits, account reviews, template decisions, policy enforcement, pricing, or feature availability. Your use of third-party services is also governed by their respective terms, privacy notices, platform policies, commerce policies, and messaging policies.

7. WhatsApp Business Platform

Use of WhatsApp-related functionality is subject to Meta's and WhatsApp's current terms, Business Messaging Policy, Commerce Policy, template rules, quality rules, rate limits, and opt-in requirements. You are solely responsible for the messages, templates, media, contact lists, automations, and campaigns you send through Wappigo. You must obtain and keep evidence of each recipient's valid opt-in before messaging them, clearly identify your business and message purpose, honor opt-out or block requests promptly, use approved templates when required, and comply with all privacy, consumer protection, telecommunication, anti-spam, KVKK, GDPR, and similar laws. Wappigo does not guarantee message delivery, account approval, template approval, phone number quality, rate limits, pricing, or uninterrupted WhatsApp service.

8. Subscription and Payments

Certain Services require a paid subscription or usage-based fees. Unless otherwise stated: subscriptions renew automatically; fees are non-refundable except where required by law; failure to pay may result in suspension of Services. Third-party messaging, WhatsApp conversation, template, number, verification, storage, AI, or infrastructure fees may be charged separately or passed through. Prices may change upon prior notice.

9. Intellectual Property

All software, trademarks, logos, designs, documentation, and content provided by Wappigo remain the exclusive property of Wappigo or its licensors. These Terms do not grant ownership rights to users.

10. User Content

You retain ownership of the content you submit through the Services, including messages, templates, media, contact records, imports, automations, and webhook payloads. By using Wappigo, you grant us a limited license to host, process, store, transmit, display, transform, and route such content solely for the purpose of providing, securing, supporting, and improving the Services. You are solely responsible for the legality, accuracy, permissions, and compliance of your content and contact data.

11. Privacy

Our collection and use of personal information are governed by our Privacy Policy. You acknowledge that Wappigo may process account data, channel connection data, message content, contact data, media, metadata, logs, and webhook data as described in the Privacy Policy. When you use Wappigo for your own customers or recipients, you are responsible for providing your own notices and obtaining required consents from those individuals.

12. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability. Maintenance, technical issues, or third-party outages may temporarily affect the Services.

13. Suspension and Termination

We may suspend or terminate your account, restrict sending, disable integrations, remove content, or preserve records if: you violate these Terms; your use creates security, platform, legal, deliverability, quality, or reputation risks; required by law or a platform provider; payment obligations remain unpaid; complaints, blocks, quality issues, or policy violations are detected. You may stop using the Services at any time.

14. Disclaimer

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Wappigo disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Wappigo shall not be liable for: indirect damages; incidental damages; consequential damages; loss of profits; business interruption; loss of data; loss of goodwill. Our total liability shall not exceed the amount paid by you during the twelve (12) months preceding the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless Wappigo and its affiliates, officers, employees, and partners from any claims, damages, liabilities, costs, or expenses arising from: your use of the Services; your violation of these Terms; your violation of applicable law; content submitted by you.

17. Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time without prior notice.

18. Changes to these Terms

We may update these Terms from time to time. Updated Terms become effective upon publication. Continued use of the Services constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by the laws of the Republic of Turkey, without regard to conflict of law principles, unless mandatory consumer or data protection laws provide otherwise.

21. Meta Platform and Instagram Features

Use of Wappigo's Meta, Instagram, and WhatsApp integrations is subject to the current Meta Platform Terms, Developer Policies, Instagram Platform rules, WhatsApp Business Terms, Business Messaging Policy, permission usage guidelines, messaging windows, and other applicable platform requirements. You authorize Wappigo to request and use only these permissions for the features you enable: business_management for WhatsApp Embedded Signup and the business assets you select; whatsapp_business_management for authorized WhatsApp Business Accounts, phone numbers, webhook subscriptions, templates, and business settings; whatsapp_business_messaging for permitted WhatsApp customer messages; instagram_business_basic for direct Instagram Login and professional account identification; and instagram_business_manage_messages for customer-initiated Instagram conversations and replies within Meta's permitted messaging window. You must use these features only for assets you own or are authorized to manage, respect opt-in, user-initiated conversation, and messaging-window rules, and provide all notices, consents, and lawful bases required by law and platform policy. Wappigo does not request these permissions for advertising, Instagram comments, content publishing, insights, or Human Agent messaging. Wappigo may limit or disable an integration when required by Meta, law, security, user choice, or platform enforcement and does not guarantee App Review, Advanced Access, account, template, or message approval.
